Windsor Lawyer Joanna Sweet Wins $2 Million Verdict for Injured Motorcyclist

,

We are pleased to announce that our managing partner, Joanna Sweet has secured more than $2 million in a jury-awarded verdict. This award is the result of a seven-year legal battle for a Windsor motorcyclist who was catastrophically injured when a driver made an illegal turn in 2019.

The verdict came after a 15-day trial in Ontario Superior Court of Justice. It represents the largest car crash jury verdict awarded in a Windsor courtroom in recent years.

Associate Laura Nicola served as co-counsel throughout the seven-year case.

The Collision and Its Consequences

In 2019, a motorcyclist was riding in Windsor when a vehicle made an illegal turn directly into his path. The collision left him with devastating injuries: cervical spine fractures, a complicated wrist fracture, a fractured femur, and a traumatic brain injury.

The crash wasn’t his fault. But rebuilding his life became his reality.

In the years since the crash, he has undergone multiple surgeries. He faces more surgical procedures ahead. His ability to provide for his family was permanently changed that day. The physical and emotional toll continues to affect him every single day.

The Insurance Company’s Offer

Before the trial, the defendant’s insurance company made a settlement offer. The amount represented a small fraction of what the injured rider needed to address his medical costs, ongoing care, lost income, and the permanent impact on his life.

For seven years, the insurance company dismissed the severity of his injuries while he endured surgeries and tried to rebuild what the collision had taken from him.

He rejected the offer and decided to take his case to a jury.

The Jury’s Verdict

After hearing 15 days of evidence and testimony, the jury awarded more than $2 million — an amount that dwarfed the insurance company’s pre-trial settlement offer.

The verdict recognized the profound and permanent impact this collision has had on every aspect of our client’s life.

Beyond the jury award, the insurance company must also pay the client’s legal costs, which will likely add hundreds of thousands of dollars to the total judgment.

Joanna Sweet, who led the case, said:

“For the past seven years this insurance company has dismissed the severity of my client’s injuries as he endured multiple surgeries and the need for more surgery in the future. His ability to provide for his family will never be the same. Every day, for the rest of his life, he will live with the consequences of a crash that was not his fault at all. We hope this award helps him get his life back on track.”

“This outcome is the product of countless hours of hard work and determination to help our client achieve a just result that recognises the full impact of his injuries on his life. Our client is grateful for the jury’s decision and he looks forward to getting this case behind him so he can focus on healing and enjoying life as best he can.”
