Tainted Tissue Lawsuit
March 22, 2006Greg Monforton and Partners has filed a $210 million class action lawsuit in connection with illegally harvested and un-screened human tissue and bone used in transplant surgery.
The suit, filed in Windsor, Ontario, names Clarence Renaud as representative plaintiff of the proposed class of plaintiffs. Mr. Renaud allegedly received illegally harvested and un-screened bone and tissue as part of a routine back surgery at Hotel-Dieu Grace Hospital in Windsor on April 27, 2003.

Statement of Claim
Health Canada warned in October 2005 that 125 people across the country received human bone, skin and tendons that were not properly screened.
Hotel Dieu Hospital reported that 21 people who underwent procedures at their hospital would need to be tested for infectious diseases. The potentially tainted tissues were used in surgeries performed between January 2003 and October 2005.
In a lawsuit filed in the United States, one woman has alleged that she contracted syphilis after receiving tainted tissue from BioMedical Tissue Services.
Tainted Tissue Provided by Biomedical
Biomedical Tissue Services, a company based in the United States, provided un-screened and potentially tainted tissue to the Hotel Dieu Hospital. Health Canada warned that the tissue was not adequately screened for such diseases as HIV, Hepatitis B and C, syphilis and human T-cell lymphotropic virus (HTLV I and II).
The company is subject to a criminal investigation for selling body parts illegally harvested from funeral homes. These body parts pose a risk of serious disease to those who receive the parts.
