Should I seek medical attention even if I don’t think I have been injured?

Seeking medical help after a car accident is important as some internal injuries are not always apparent. Additionally, having medical records that document the injuries you suffered at the hands of a negligent driver can help build a strong claim or lawsuit if you choose to pursue damages.

What types of damages may I qualify for?

The types of damages a victim may qualify for can vary but they are typically property damage, medical expenses, lost wages, and pain and suffering. Those who have lost a loved one in a fatal car accident may be entitled to file a wrongful death claim.

What should I do if the driver fled the scene?

According to the Ontario Ministry of Transportation, more than 250 drivers were charged with failing to remain at the scene of an accident. If you are involved in a hit-and-run accident, make sure you write down any details you recall about the vehicle and the driver. A police report should also be filed as law enforcement may be able to find the other person involved in the crash.

How long do I have to file a claim?

According to the 2002 Limitations Act, victims have two years in Ontario to file a claim for highway traffic accidents. The statute of limitations can vary by province; if you are involved in an accident outside of Ontario be sure you know how long you have to file a claim.

If I was the passenger in an auto accident, can I still make a claim?

As a passenger in a serious car collision, you have rights. Whether it is filing a claim against an insurance company for failing to provide adequate compensation for your injuries or against the negligent driver that caused your injuries, a passenger may still be eligible to make a claim.

What should I do after an accident?

After an accident call for medical assistance if needed as well as for law enforcement in order to report the crash. Try to recall the events leading to the accident and only provide accurate, truthful information when recounting the collision to law enforcement. You should also take photographs of the accident scene, damage to your car, and injuries sustained. All of these steps can help build a stronger claim.

How can a lawyer help me?

A lawyer can help investigate your claim, gather evidence and witness testimonies, and help file a claim or lawsuit on your behalf. A lawyer can help you fight for the compensation you deserve and help to guide you through the litigation process.
