Windsor lawyer Greg Monforton today announced that the City of Windsor and a Michigan trucking company have agreed to settle a lawsuit commenced against them by the surviving children of the late Jacqueline Bouchard.
Ms. Bouchard died after being struck by a transport truck on October 16, 2003 while walking across Huron Church Road at Girardot Street. Monforton said: “traffic engineering experts retained by us confirmed that the pedestrian crossing and traffic stop bars were poorly configured and that this presented an unnecessary safety hazard”.
The amount of damages was not specified but Mr. Monforton indicated that the family is extremely pleased with the settlement.
Monforton, senior partner of Greg Monforton & Partners and President of the Ontario Trial Lawyers Association, said that Ms. Bouchard’s children (Nicholas, Danielle and Michel) “are happy to see this court case end. They are also gratified to know that this preventable tragedy resulted in the construction of a pedestrian crossing bridge near the site of the accident and a new design for the old crosswalk. There are now safe alternatives when pedestrians want to cross Huron Church Road”.
