Jubenville Case Ruling Detailed in Canadian Underwriter

Earlier this month, Canada's Insurance and Risk Magazine Canadian Underwriter reported on the recent victory for Greg Monforton and Partners in the Jubenville v. Economical Mutual Insurance Company in Ontario's appeal court. The article, written by Underwriter's Associate Editor, Greg Meckbach, details the ruling that allowed Ashley Jubenville to be eligible for coverage in a twenty-year-old accident case.
The case, successfully argued by Laura M. Pearce, involved Ashley Jubenville, the accident victim who was 5-years-old at the time of the incident, Ashley's mother Kelly and father Kevin. The appeals case was brought by Economical Insurance, the insurance carrier that had covered Kelly's vehicles, but not Kevin's Mercury Cougar that was involved in the single vehicle accident.
